Your property, your next step
Legal support from the first offer
to the next chapter.
The right enquiries depend on whether you are buying, preparing to sell, or changing a property you already own.
Buying: match the checks to the property
We investigate ownership, charges, contracts and the home's documented position. A village-core house, an apartment in a development and a hillside villa present different practical questions, especially where the purchase depends on an altered façade, enclosed terrace, extension or future building work.
Discuss a purchaseSelling: bring alterations into the open
We review the sale terms and help prepare the legal documentation. Tell us about additions, converted spaces or exterior changes so the physical property can be compared with its deed, Land Registry, Cadastre and available permissions before a buyer's enquiries compress the timetable.
Plan your saleRenovating: test the idea against the site
For renovation, extension or new-building plans, we set the legal enquiries and work with a local architect on the mapped planning category, existing structure, terrain and proposed design. A similar-looking project elsewhere in Benalmádena is not confirmation of what applies to this plot.

Why the address matters
Traditional cores, apartments and hillside homes
Benalmádena combines several residential settings within one municipality. The planning questions for a property in a designated traditional core can differ from those for an apartment block, a single-family home or a sloping site.
Designated traditional cores
The published municipal norms contain traditional-core categories for Benalmádena Pueblo and Arroyo de la Miel. The provisions seek to preserve character and address façades and exterior details in the relevant areas.
For your property: Confirm the mapped category and current rules before assuming that a general village aesthetic or one neighbouring façade determines your proposal.
Apartments and varied residential zones
The plan's ordinance structure distinguishes single-family housing, extensions of the core, open apartment blocks and Pueblo Mediterráneo categories. These are planning classifications, not automatic labels for every property in a named settlement.
For your property: Identify the property's actual zone, approved configuration and any community-consent issue before relying on an enclosure, redistribution or exterior alteration.
Hillside properties
The municipal planning material recognises Benalmádena's mountainous terrain as distinct from its more developed coastal settings. On a sloping site, access, levels, retaining works and the existing building can require closer technical investigation.
For your property: Ask a local architect which surveys and current planning checks are proportionate to the site and the specific works; slope alone does not prove a defect.
Renovation, extensions and building records
Permission to build.
Paperwork that reflects the building.
Future permission and the records for what already exists require separate checks. Define the intended work, identify the mapped category and any community consent, then compare the home with the deed, Land Registry, Cadastre and available municipal documentation before relying on its current or proposed layout.
Obra mayor and renovation works
New construction, extensions and structural alterations can require a technical project and the appropriate municipal authorisation. The scope of the work determines the route. Calling a job obra menor (minor works) does not automatically mean that no project or other permission is needed.
Licence or declaración responsable?
The applicable procedure depends on the works, the property and current rules. Some work may follow a responsible-declaration procedure rather than a prior licence, but that is not a general exemption from planning requirements or any other consent that applies.
Declaración de obra nueva
This is the formal declaration of a building or extension for its deed and Land Registry record. It is a separate question from permission to carry out the works. Recording a building does not, by itself, make unauthorised work lawful.
Two questions worth asking early
“Can I extend a hillside villa or add a pool?”
The answer depends on the plot, planning category, existing building, terrain, design and current municipal requirements. A local architect should assess the address and proposal while we review the legal records and permission history.
“The enclosed terrace is not shown in the documents. What should I do?”
Have the difference investigated before purchase or sale deadlines take over. We review the available legal and municipal records and coordinate measurements or other technical evidence needed to understand the building's actual and documented position.

Before you get in touch
Your questions,
answered.
Do you have an office in Benalmádena?
Our office is in Almuñécar. We assist clients with Benalmádena property and work with local architects when planning or technical input is required. You can begin by phone, email or online enquiry, including from outside Spain.
Are Benalmádena Pueblo, Arroyo de la Miel and Benalmádena Costa separate planning authorities?
No. They are within Benalmádena municipality. Different mapped categories and detailed instruments may apply within it, so the settlement name is a starting point for locating the property rather than a complete planning answer.
Can I change the façade of a home in a traditional-core area?
The published norms address façades and exterior details in designated core categories, but the current classification, level of work and later planning material must be checked. We coordinate the legal enquiry with a local architect's design assessment.
Can I contact you before choosing a property or paying a deposit?
Yes. Tell us the area, your plans and any deadlines. If you have found a property, share a short outline before signing or paying so that we can discuss the enquiries and proposed work. If you have already signed, explain what was agreed and any dates involved.
