Your property, your next step
Legal support from the first offer
to the next chapter.
The right enquiries depend on whether you are buying, preparing to sell, or changing a property you already own.
Buying: verify the home and your plans
We investigate ownership, charges, contracts and the property's documented position. If you are choosing between an apartment, a traditional town-centre home or another residential property, tell us about any planned terrace, roof or layout changes so the relevant enquiries begin before you rely on them.
Discuss a purchaseSelling: prepare for the buyer's questions
We review the sale terms and help assemble the legal documentation. Extensions, terrace enclosures, altered openings or changes of use can prompt questions during a sale, so differences between the building and its records should be identified early rather than at completion.
Plan your saleRenovating: check the proposal first
For renovation or extension plans, we define the legal enquiries and work with a local architect on the current planning category, the existing building and the proposed design. The advice must follow the particular address; an alteration seen elsewhere in the city is not evidence that yours is permitted.

Why the address matters
Traditional cores and a wider urban housing market
Fuengirola includes the traditional centres of Fuengirola and Los Boliches alongside apartment blocks and other forms of housing. That variety changes which documents and design questions matter for a purchase or renovation.
Fuengirola and Los Boliches cores
The published PGOU includes a Núcleo Tradicional ordinance for the old cores of Fuengirola and Los Boliches, describing compact street-aligned buildings. Its provisions address façades and roofs as part of the area's character.
For your property: Confirm whether the property is actually within the mapped traditional-core area before drawing conclusions about exterior or roof works.
Apartments and shared buildings
Many purchases concern apartments where the sale documents, authorised configuration and community arrangements all deserve attention. A private interior project may still affect common elements or the building's approved appearance.
For your property: Review the deed, Land Registry information, available municipal records and community approvals relevant to the specific alteration.
Other residential zones
The municipal plan distinguishes several building forms beyond the traditional core, including closed blocks and detached or attached housing. A neighbourhood label or an agent's description does not identify the governing planning category.
For your property: Have the mapped zone and current planning documents checked before treating a neighbouring extension, roof terrace or enclosure as a precedent.
Renovation, extensions and building records
Permission to build.
Paperwork that reflects the building.
Permission for future works and the paperwork for the building as it stands are related but separate questions. Establish the route for the proposed work, any community consent and whether the deed, Land Registry, Cadastre and available permissions describe the same property.
Obra mayor and renovation works
New construction, extensions and structural alterations can require a technical project and the appropriate municipal authorisation. The scope of the work determines the route. Calling a job obra menor (minor works) does not automatically mean that no project or other permission is needed.
Licence or declaración responsable?
The applicable procedure depends on the works, the property and current rules. Some work may follow a responsible-declaration procedure rather than a prior licence, but that is not a general exemption from planning requirements or any other consent that applies.
Declaración de obra nueva
This is the formal declaration of a building or extension for its deed and Land Registry record. It is a separate question from permission to carry out the works. Recording a building does not, by itself, make unauthorised work lawful.
Two questions worth asking early
“Can I enclose the terrace or change the roof?”
The answer depends on the building, mapped zone, scope of work, current municipal requirements and, for an apartment, possible community consent. Ask for a property-specific assessment before making the purchase depend on that change.
“The apartment layout differs from the documents. What now?”
The difference needs investigation rather than an assumption that it is harmless. We compare the transaction documents and available permissions, then coordinate technical input where measurements, plans or the building's authorised configuration need to be understood.

Before you get in touch
Your questions,
answered.
Do you have an office in Fuengirola?
Our office is in Almuñécar. We assist clients with Fuengirola property and work with local architects when planning or technical input is needed. You can begin by phone, email or online enquiry, including from abroad.
Do the Fuengirola and Los Boliches traditional-core provisions apply everywhere?
No. The published plan identifies a specific Núcleo Tradicional category, while other parts of the municipality have different residential ordinances. The mapped classification and any later planning material must be checked for the address.
Can an estate agent confirm a Fuengirola property's renovation potential?
An agent's view can help explain the opportunity, but it is not a property-specific planning determination. Where the purchase depends on changes, we coordinate the legal review with a local architect's current technical assessment.
Can I contact you before choosing a property or paying a deposit?
Yes. Tell us the area, your plans and any deadlines. If you have found a property, share a short outline before signing or paying so that we can discuss the enquiries and proposed work. If you have already signed, explain what was agreed and any dates involved.
