Your property, your next step

Legal support from the first offer
to the next chapter.

The right enquiries depend on whether you are buying, preparing to sell, or changing a property you already own.

Buy with the right municipal context

We investigate ownership, charges, contracts and the property’s documented position. Where location, alterations or future works matter, we identify the relevant Vélez-Málaga planning material and coordinate technical questions with a local architect before you commit.

Discuss a purchase

Prepare a coastal property for sale

We help sellers assemble the legal documents, review the proposed contract and address issues likely to concern a buyer. If a terrace has been enclosed, rooms reconfigured or common areas affected, tell us early so the records and approvals can be examined.

Plan your sale

Plan renovation or an extension

We help establish the legal route for intended works and ask a local architect to assess the planning and technical position. This is especially useful where the purchase price assumes a larger opening, roof changes, added space or a substantial redesign.

Why the address matters

A coastal town within a larger municipality.

Torre del Mar is part of Vélez-Málaga municipality. Its council brings together the general planning framework, later adaptations and amendments, and plans in preparation. The current instrument and mapped area matter more than the locality name alone.

Start with Vélez-Málaga planning

The municipality covers Torre del Mar and other settlements, and its planning portal publishes the general framework alongside later modifications. A buyer should therefore establish which document and mapped conditions govern the individual building or plot.

For your property: Confirm the address, planning area, relevant amendment or detailed instrument, and any outstanding development obligations before relying on a marketing description.

The fort area is a specific pocket

The approved Fuerte de Torre del Mar amendment concerns a defined area around the historic fort and named execution units. Its supporting report considers the protected fort, neighbouring building types, access, public space and land management together.

For your property: First establish whether the property is actually inside or affected by the amendment boundary. The file must not be treated as a rule for all Torre del Mar.

Apartments, terraces and shared elements

For an apartment in Torre del Mar, the private home and the shared building need to be considered together. A terrace enclosure or façade alteration can raise both municipal planning questions and questions about community rules or approvals. An existing alteration is not proof that both were addressed.

For your property: Compare the apartment with its documented configuration and available permissions. Review the community documents and relevant decisions before assuming that a similar alteration elsewhere in the block permits yours.

Renovation, extensions and building records

Permission to build.
Paperwork that reflects the building.

For renovation or extension work, the proposed design and the existing building both need attention. Before budgeting around a new terrace, altered frontage or additional space, establish the required procedure and whether the deeds and property records reflect what is already there.

Obra mayor and renovation works

New construction, extensions and structural alterations can require a technical project and the appropriate municipal authorisation. The scope of the work determines the route. Calling a job obra menor (minor works) does not automatically mean that no project or other permission is needed.

Licence or declaración responsable?

The applicable procedure depends on the works, the property and current rules. Some work may follow a responsible-declaration procedure rather than a prior licence, but that is not a general exemption from planning requirements or any other consent that applies.

Declaración de obra nueva

This is the formal declaration of a building or extension for its deed and Land Registry record. It is a separate question from permission to carry out the works. Recording a building does not, by itself, make unauthorised work lawful.

Two questions worth asking early

“Can I change the terrace, façade or layout?”
The answer depends on the property, the scope of work, the applicable municipal rules and, for apartments, any community considerations. We define the legal enquiries and coordinate a local architect’s review of the proposal.

“A planning map shows a future pedestrian area. Is it already settled?”
A plan can establish an intended arrangement without proving that land assembly, urbanisation or construction is complete. We check the approved documents and current implementation position relevant to the property.

Before you get in touch

Your questions,
answered.

Where is your office?

Our office is in Almuñécar, on the Costa Tropical. We assist clients with property in Torre del Mar, and you can start by phone, email or the enquiry form. We work with local architects where planning or technical input is needed.

Which council controls planning in Torre del Mar?

Torre del Mar is within the municipality of Vélez-Málaga. The relevant general plan, adaptations, amendments and local files are published through Vélez-Málaga’s municipal planning service.

Does the Fuerte de Torre del Mar amendment affect every property in town?

No. It relates to a defined area around the fort and specific execution units. The boundary and the individual property file must be checked before drawing any conclusion from it.

What if an apartment has an enclosed terrace?

Tell us before you commit. We examine the available property, municipal and community records and coordinate technical input where needed. The fact that the enclosure is already there does not establish that its planning and shared-building implications have been resolved.

Can I contact you before choosing a property or paying a deposit?

Yes. Tell us the area, your plans and any deadlines. If you have found a property, share a short outline before signing or paying so that we can discuss the enquiries and proposed work. If you have already signed, explain what was agreed and any dates involved.
