Personal Legal Services
Planning to move to another country, either short term or as a resident, will give rise to legal and fiscal implications. For residents and non-residents we can provide advice on:
Private Taxation and VAT
- Property Taxes
- Capital Gains Tax
- Inheritance and Gift Taxes
- Tax Planning
Residency Permits
If you plan to stay for more than 6 months or work then residency may be required.
Wills and Probate
Spanish laws of inheritance will differ from your home country and we strongly recommended to our clients who own property or have assets here, that they have a Spanish Will. This can be done easily and it does not affect any other Will that you may have in any other country. All our wills are drafted into Spanish and English
Finance and mortgages
Raising a mortgage in Spain may be an attractive proposition as the rates may be lower than in your country. Details required will be proof of earnings, payslips, etc. A valuation by a bank surveyor will also be required. We have contacts with the largest banks in the area and will search for the most attractive deal. We will explain all the terms and conditions relating to any borrowings, as well as the interest and expenses.
Bear in mind that repayments will be in Euros and rates do change. Apart from an arrangement fee; mortgages attract a stamp duty (1% in Andalusia, 0.5% in Murcia, according to the region). It is wise to plan ahead to finance your purchase and we will be pleased to help.
Insurance
An area often overlooked by some buyers. Once the property is purchased then it is prudent to find insurance from a reputable company at the best price.
Motor and Marine Law
Before buying or importing a boat or car into Spain, it is advisable to find out all the rules and regulations, as they may differ significantly from your home country.
