Failure to do this will incur different types of problems including fines and road tax of the new owner being sent and charged to the former owner.<\/p>\n<p>Transfer of ownership details is made at the office of the\u00a0 <em>\u201cDirecci\u00f3n General de Tr\u00e1fico\u201d<\/em> (the Traffic department of the police) Both the buyer and seller must attend to submit the paperwork or they can delegate to an agent.<\/p>\n<h4>Duties of the seller<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-2412\" src=\"https:\/\/www.velascolawyers.com\/wp-content\/uploads\/2021\/03\/car2.jpg\" alt=\"\" width=\"197\" height=\"140\" \/><\/h4>\n<p>For a second hand sale the seller will have to provide the following documentation:<\/p>\n<ul>\n<li>\u00a0\u00a0\u00a0 The<em> \u201cpermiso de circulaci\u00f3n\u201d<\/em> along with the <em>\u201cficha de caracter\u00edsticas t\u00e9cnicas\u201d<\/em> (the document specifying the model and the characteristics of the vehicle).<\/li>\n<li>\u00a0\u00a0\u00a0 The receipts of payments of the<em> \u201cImpuesto de Veh\u00edculos de Tracci\u00f3n Mec\u00e1nica\u201d<\/em>, (equivalent to the road tax)<\/li>\n<li>\u00a0\u00a0\u00a0 If the vehicle is more than 4 years old, the documents from the ITV (\u201c<em>Inspecci\u00f3n T\u00e9cnica de<\/em> <em>Veh\u00edculos\u201d<\/em> equivalent to the MOT).<\/li>\n<\/ul>\n<p>It is important that in the sale purchase contract (<em>Contrato de Compraventa<\/em>) the precise date at which the vehicle is handed over appears,\u00a0 in order to determine the responsibility for fines or accident immediately before or after the sale. The details of the buyer and seller must appear with copies of the DNI, NIE (or CIF in case of a company) attached to the contract.<\/p>\n<p>The seller will have 10 days after the handing over to notify the \u201c<em>Direcci\u00f3n General de Tr\u00e1fico<\/em>\u201d (the Traffic department of the police) that the vehicle has been sold by filling a special form (tr\u00e1mite de notificaci\u00f3n de venta). This is especially important and where most of the problems originate. Doing this eliminates the seller from the responsibility of fines, road tax, and civil responsibility.<\/p>\n<p>After signing the purchase contract and the car is handed over, the buyer has 15 days to give to the seller a copy of the new <em>\u201cpermiso de circulaci\u00f3n<\/em>\u201d certifying the vehicle now belongs to the new owner.<\/p>\n<h4>Duties of the buyer<\/h4>\n<p>The buyer will have to register the vehicle\u2019s new ownership in the database of the traffic department.<\/p>\n<h5>If the buyer purchased the vehicle from a second hand car dealer:<\/h5>\n<p>Most of the time the dealer will take care of the paperwork, giving to the buyer the \u201c<em>permiso de<\/em> <em>circulaci\u00f3n\u201d<\/em> already in his name and the ITV document certifying that the vehicle passed the ITV check.<\/p>\n<h5>If the buyer purchased the vehicle from a private person:<\/h5>\n<p>The buyer needs to have the following documentation:<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-2410\" src=\"https:\/\/www.velascolawyers.com\/wp-content\/uploads\/2021\/03\/car-3.jpg\" alt=\"\" width=\"252\" height=\"130\" \/><\/p>\n<ul>\n<li>\u00a0\u00a0\u00a0 Sale contract (signed by both parties)<\/li>\n<li>\u00a0\u00a0\u00a0 Form requesting the change of ownership (<em>Solicitud de cambio de Titularidad del Veh\u00edculo<\/em>) signed by both parties<\/li>\n<li>\u00a0\u00a0\u00a0 Documents from the ITV check (up to date)<\/li>\n<li>\u00a0\u00a0\u00a0<em> Permiso de circulaci\u00f3n<\/em><\/li>\n<li>\u00a0\u00a0\u00a0 Spanish NIE and Passport. If the buyer is a foreign national, \u00a0a certificate from the town hall (<em>empadronamiento<\/em>) or residency permit.<\/li>\n<li>\u00a0\u00a0\u00a0 The receipts of payments of the \u201c<em>Impuesto de Veh\u00edculos de Tracci\u00f3n Mec\u00e1nica&#8221;<\/em> from the previous year.<\/li>\n<\/ul>\n<p>After this the buyer has 30 days to:<\/p>\n<ol>\n<li>\u00a0\u00a0 Pay transfer tax (modelo 620) to the tax department of the local Autonomous Community, providing all the above documentation.<\/li>\n<li>\u00a0\u00a0 Pay road tax and file the form of \u201c<em>Solicitud de cambio de Titularidad del Veh\u00edculo<\/em>\u201d to the traffic department.<\/li>\n<\/ol>\n<h5>The guarantee<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-2411\" src=\"https:\/\/www.velascolawyers.com\/wp-content\/uploads\/2021\/03\/car1.jpg\" alt=\"\" width=\"243\" height=\"136\" \/><\/h5>\n<p>The seller is responsible of hidden defects that the vehicle may have and that were not apparent immediately.<\/p>\n<p>If the purchases takes place between individuals, the buyer may choose to renounce this guarantee and buy the vehicle \u201cas is\u201d, whereas if the seller is a professional dealer he will be held responsible for any defects that the vehicle may present after purchase.<\/p>\n<h5>The insurance policy<\/h5>\n<p>If buyer and seller agree, it will be possible to transfer <em>(subrogate<\/em>) the insurance policy to the new owner. Buyer and seller should check with the insurance company of the best procedure. This operation will have to be done within 15 days after the sale.
