The entire law and its amendments can be found on the website of the<em> Ministerio para la Transici\u00f3n Ecol\u00f3gica<\/em> (Ministry for Ecological Transition) on <a href=\"https:\/\/www.miteco.gob.es\/es\/costas\/temas\/modificacion-ley-costas\/\">https:\/\/www.miteco.gob.es\/es\/costas\/temas\/modificacion-ley-costas\/<\/a><\/p>\n<p>The Coastal Law defines several management areas and legal easements at all Spanish coasts.<\/p>\n<p>&nbsp;<\/p>\n<h4>Definitions of Domains:<\/h4>\n<h5><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-2564 alignleft\" src=\"https:\/\/www.velascolawyers.com\/wp-content\/uploads\/2020\/03\/beach.jpg\" alt=\"\" width=\"254\" height=\"169\" srcset=\"https:\/\/www.velascolawyers.com\/wp-content\/uploads\/2020\/03\/beach.jpg 1024w, https:\/\/www.velascolawyers.com\/wp-content\/uploads\/2020\/03\/beach-300x200.jpg 300w, https:\/\/www.velascolawyers.com\/wp-content\/uploads\/2020\/03\/beach-768x512.jpg 768w\" sizes=\"(max-width: 254px) 100vw, 254px\" \/><\/h5>\n<p>&nbsp;<\/p>\n<h5><\/h5>\n<h5><\/h5>\n<h5><em>Dominio P\u00fablico Mar\u00edtimo-Terrestre<\/em> (Maritime-Terrestrial Public Domain):<\/h5>\n<p>This area comprises the tidal zone of the beach, the beach itself and, if present, the dunes behind it. This area belongs to the state, and other than in specific cases it cannot be owned privately.<\/p>\n<h5><em>Deslinde<\/em> (Demarcation line):<\/h5>\n<p>This is the line separating the sea front area of public ownership from the interior part of the coast.<\/p>\n<h5><em>Zona de servidumbre de protecci\u00f3n<\/em> (easement area for protection of the coasts):<\/h5>\n<p>This is a 100m wide band from the demarcation line (deslinde) to the interior which can be expanded up to 200 m. In areas classified as urban in December 1989 the width decreased to 20m. In this area building is forbidden. This band must remain freely accessible to pedestrians and emergency vehicles.<\/p>\n<h5><em>Zona de servidumbre de tr\u00e1nsito<\/em> (transit easement area):<\/h5>\n<p>This area is directly behind the demarcation line into the interior with a width of 6m. It is part of the protected easement area. Exceptionally the width can be increased up to 20m for places with access difficulties (cliffs or mountains for example).<\/p>\n<h5><em>Zona de influencia<\/em> (influence zone):<\/h5>\n<p>This is a 500m wide band from the demarcation line (deslinde) to the interior. The local administrations must manage this area in order to include services (for example parking areas close to popular beaches) and to limit the height of buildings and other architectonical characteristics.<\/p>\n<h4>Buildings in the Public Domain Zone (DPMT) and the Protected Easement Area<\/h4>\n<p>Already existing and legally built houses in these areas can be maintained in the same conditions, although not in form of ownership. The owners will get a right of occupation and exploitation in form of a concession. This concession is granted for 75 years.<\/p>\n<p>New buildings are not allowed, neither hotels nor apartment buildings nor houses. Constructions already present in December 1989 will be allowed, but regulated in the following way:<\/p>\n<ul>\n<li>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Only allowed are repair works, works of improvement, consolidation and modernisation that do not imply an increase of volume, height or surface of the building. Any extension will be strictly forbidden.<\/li>\n<li>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Those works must include an improvement in energy efficiency by two letters or a letter B to be proved by the respective energy efficiency certificate.<\/li>\n<li>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The works must also improve the water consumption.<\/li>\n<li>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The works must be applied for in advance at the Autonomous Administration (for example the Junta de Andaluc\u00eda) by means of a statement of compliance (declaraci\u00f3n responable), before applying for the building license at the local Town Hall.<\/li>\n<li>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 If the transit easement will be affected by the works, a favourable report from the State Administration is necessary which states that the transit easement is guaranteed.<\/li>\n<\/ul>\n<p>For maintenance works at private buildings must be presented the basic project (proyecto b\u00e1sico) indicating, among others, the characteristics of the installations and works which will be executed and the extension of the area of DPMT which will be used. Before starting the works, the detailed engineering and design project (proyecto de construcci\u00f3n) must be presented. Furthermore, an economic-financial study must be added and the estimated budget of the works.
